The Protection of Legitimate Expectations under Administrative Law in France

Résumé

Despite appearances, the protection of legitimate expectations is fairly well guaranteed in French administrative law. Although the principle is not recognised, its logic continues to innervate many parts of positive law. The Council of State (Conseil d’Etat) has also ultimately applied its subjective mechanism without stating so, under the more general label of the principle of legal certainty.
